Dismissal of Dental Board Complaint for Houston-Area General Dentist

Garcia & Gibbs, LLP is proud to congratulate firm partner Stacy Garcia on obtaining the dismissal of a complaint before the Texas State Board of Dental Examiners on behalf of a respected Houston-area general dentist.

The complaint alleged that the dentist failed to provide appropriate treatment and did not adequately discuss all available treatment options with a patient. Like many healthcare providers facing a board investigation for the first time, the dentist initially responded to the complaint independently. However, when the matter advanced and an Informal Settlement Conference (ISC) was scheduled, the provider retained Ms. Garcia to assist with the defense.

Building a Strong Response

After being retained, Ms. Garcia immediately began working with the dentist to understand not only the allegations, but also the provider's overall practice history and professional background.

Together, they reviewed the records, organized supporting documentation, and prepared a comprehensive rebuttal addressing the concerns raised by the Board. The response focused on the care provided, the clinical decision-making involved, and the information communicated to the patient throughout treatment.

Importantly, the defense went beyond the treatment records alone.

Telling the Provider's Full Story

One of the most valuable aspects of board representation is ensuring that licensing authorities understand the provider behind the complaint.

As Ms. Garcia prepared the case for the ISC, she spent time getting to know the dentist's professional background, including her longstanding service to the Houston community, her commitment to patient care, and her history of mentoring younger dentists entering the profession.

The response highlighted that the provider had built an excellent reputation throughout her career, had maintained a strong professional record, and had never previously faced a board complaint. This broader context helped the Board better understand the provider's character, professionalism, and commitment to ethical patient care.

A Successful Outcome

Following review of the rebuttal materials and the information presented on the provider's behalf, the Board agreed with Ms. Garcia's assessment of the case.

The complaint was dismissed.

The dismissal allowed the dentist to continue serving patients without disciplinary action and validated the importance of presenting a complete picture of the provider and the care at issue.

Why Experience Matters in Licensing Board Matters

Board complaints are often about more than the allegations contained in the initial filing. While medical and dental records are critical, they frequently tell only part of the story.

An effective defense requires understanding the provider's clinical judgment, professional history, community involvement, and commitment to patient care. It also requires presenting that information in a way that helps Board members see the complete context surrounding the complaint.

This case demonstrates the value of working with counsel who takes the time to know the provider, understand the provider's practice, and advocate for the provider as a person, not just as a respondent in a Board investigation.

At Garcia & Gibbs, LLP, Stacy Garcia is committed to helping healthcare professionals navigate licensing board investigations with thorough preparation, strategic advocacy, and a deep appreciation for the careers and reputations that are at stake. We are proud of this successful outcome and honored to continue representing dentists, physicians, and healthcare providers throughout Texas.
